This agreement is between the named couple and Louise Barry of ‘Louise Barry Photographer’.

Booking fee: £150.00 

The £150 booking fee is due on signing this agreement. The remaining balance of the amount agreed due 28 days before the day of the wedding, stated on the invoice.

CONFIRMATION: This signed contract and payment of the deposit are necessary to confirm the stated wedding services from the Photographer. 

PRE-WEDDING CONSULTATION: This normally happens at the time of booking. The couple will outline broadly what is required and the Photographers will advise on planning, logistics and timings were needed. If required, the couple are welcome to a zoom call for an additional chat closer to the time of the wedding (about 4 weeks prior) to iron out the remaining details.

CO-OPERATION: The couple and the Photographers consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. We recommend that the wedding photographer be provided with a helper (usually the best man) who will point out key individuals to be photographed. The photographer may also require the assistance of the best man in organising family groups. The couple also agree to give the photographer(s) sufficient warning of key events at the wedding to give the photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at wedding like having their photo taken. In such cases the wedding photographer will use his discretion but cannot be held responsible for a lack of photos of these people. 

THE SCHEDULE: Our shooting schedule, style of working and experience are designed to achieve a great set of wedding photos for the couple, accomplished with good humour and enjoyed by all concerned. Both the couple and the Photographers therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by the bride/groom arriving to the church) we cannot guarantee to take our normal set of photos although in such circumstances we will do our absolute best to compensate. 

PAPARAZZI WEDDING GUESTS: All your guests will have digital cameras and all your guests will want to photograph the couple. In the spirit of cheerful cooperation, the couple agree to give the Photographers precedence over your guests in order to take the photographs required for the wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the couple have continually interrupted the photographer’s work. We cannot be liable for the dislike of photographs that contain guests taking photographs with the photograph. If this is something you feel strongly about I would advise speaking to the wedding venue/ registrars about making an announcement pre-ceremony.

HOUSE RULES: Note the Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the Photographers shoot from a specific location. In such circumstances the couple agree to accept the technical limitations that may be imposed on the equipment used. We advise the couple to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned. 

COPYRIGHT LAW: English Copyright Law states that the copyright of photographs remains with the photographer. The Photographers grant the Couple permission to make copies of the images under the following conditions. The images taken by the Photographers are for personal use by the couple and their friends and relatives. Selling, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographers.  

MODEL RELEASE: The Couple grant the Photographers and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the couple for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Couple hereby release the Photographers and its legal representatives, heirs and assigns from all liability and claims in connection with the images. The signing of this contract allows named Photographers to share images of the bride, groom and attendees of the wedding on social media accounts.  

LIMIT OF LIABILITY: If a photographer is too ill or becomes injured and cannot supply the wedding services specified above the Photographer will try and supply a replacement wedding photographer with similar shooting styles. If a replacement photographer cannot be found, then liability is limited to a refund of any payments received. The Photographers have working methods in place to prevent the loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.  

BOOKING FEE/DEPOSIT/PAYMENTS: Upon payment of the booking fee, the client has the 14 day cooling off period and a full refund of the booking fee is refundable. After 14 days it will be considered as liquidated damages to the Photographer and the deposit will be kept. The remaining balance is due 1 month before the agreed date. If any cancellations are made within 2 months of the agreed date 50% of the remaining balance is to be paid. If a cancellation is made within 2 weeks of the wedding the full balance will remain with the photographer and not be refunded. If not yet paid, 100% of the remaining balance is still to be paid to the photographer. Should a postponement need to be made 50% of the final balance will be due on the original final payment date and the remaining 50% due on the new final payment date (one month before your new wedding date.)

ATTENDANCE: In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.

PHOTOGRAPHY STYLE AND ACCURACY: The client agrees that the photographer can only capture the wedding that happens, weather, location, schedule complications, time restraints and subjects ability to cooperate are all factors in the quality of the photographs. The photographer will not edit for physical size, hair, nor any other physical appearance issue other than blemishes. The client agrees that the work delivered will be of a similar style and calibre to those photographs on our website and blog, and that the photographer will have complete creative control during the photographs and in post-processing. The images will be delivered in JPEG format with a mix of colour and black and white images, and deemed appropriate by the photographer. No re-editing will be done after the final edited copies are presented to the client without additional charge.

HARASSMENT: Ensuring the appropriate behaviour of all guests and other persons at the wedding and other events covered by the Photographer shall be the responsibility of Client. In the event Photographer or his/her employee experiences any inappropriate, threatening, hostile or offensive behaviour from any guest or other person at the wedding or other event then the following processes shall be followed; verbal warnings, the offending person will be required to leave the wedding, the Photographer will end wedding coverage immediately and leave the event, the Photographer shall be entitled to retain all monies paid hereunder and Client agrees to relieve and hold the Photographer harmless as a result of incomplete wedding or event photography coverage.

ALBUM DESIGN: If an album is purchased as part of a package, an add-on to the day or after the wedding date, the image selection must be made within 6 months of the album enquiry. The payment must also be paid before the album can be sent for print. Delays in payment will cause delays in production. If no image selection or postage payment has been made the photographer reserves the right to cancel the album order and keep part payment for admin work made.

IMAGE STORAGE: The photographer will supply you with images via USB or gallery as discussed. It is your responsibility to keep these images safe and back up where possible. The photographer will keep a copy of these images on a hard drive for 2 years [24 months] from the date of your wedding. To create space for new clients, your images will be deleted from the hard drive and no back up copies will remain with the photographer.
